Buyer Terms

These Buyer Terms (“Terms”) apply to all users who purchase products through the K‑Patented Products Marketplace (the “Marketplace”, “Platform”, “we”, “us”, or “our”).
By placing an order on this Marketplace, you agree to these Buyer Terms, as well as our Terms of Use and Privacy Policy.


1. Role of the Marketplace

1.1 Platform only
Our Marketplace provides an online platform that connects buyers with independent third‑party vendors (“Vendors”). We do not manufacture, own, or control the products sold by Vendors.

1.2 Separate contracts
When you place an order, you are entering into a direct contract with the Vendor supplying that product. We are not a party to the sales contract between you and the Vendor, but we may assist with coordination and support.

1.3 Vendor responsibility
Each Vendor is solely responsible for:

  • Product descriptions, images, and pricing
  • Inventory and fulfillment (shipping, delivery)
  • Quality, safety, and compliance of the products
  • After‑sales service and warranty (if any)

2. Eligibility to Purchase

2.1 Age and legal capacity
By placing an order, you represent that you:

  • Are at least the age of majority in your jurisdiction, and
  • Have the legal capacity to enter into binding contracts.

2.2 Business vs. consumer buyers
Some products or services may be intended for business buyers only. Where this is the case, you confirm that you are purchasing for business use and have the appropriate authority to act on behalf of your organization.


3. Account & Information Accuracy

3.1 Account use
You may be required to create an account and log in to place an order. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

3.2 Accurate information
You agree to provide and maintain accurate, complete, and up‑to‑date information, including:

  • Billing and shipping address
  • Contact details
  • Tax or customs information (if applicable)

If your information is incorrect or incomplete, your order may be delayed, cancelled, or returned.


4. Orders, Pricing & Payment

4.1 Placing an order
When you place an order through the Marketplace, you are making an offer to purchase products from the relevant Vendor(s). The Vendor may accept or reject your order at its sole discretion (for example, in case of out‑of‑stock, pricing errors, or restricted destinations).

4.2 Order confirmation
After you place an order, you will receive an order confirmation email. This confirms that we have received your order, but does not guarantee acceptance by the Vendor.

4.3 Pricing & taxes
Product prices, shipping fees, and applicable taxes are displayed at checkout. Final amounts may vary depending on:

  • Currency conversion
  • Applicable VAT/GST or sales tax
  • Customs duties and import taxes (if any)

You are responsible for any additional customs duties or import fees charged by your local authorities.

4.4 Payment processing
Payments may be processed by us or by third‑party payment service providers. You authorize us and/or our payment processors to charge your selected payment method for the total order amount, including taxes and shipping.


5. Shipping, Delivery & Risk

5.1 Shipping by Vendors
Products are shipped directly by the Vendors. Shipping methods, fees, and estimated delivery times may vary and are shown on the product and checkout pages.

5.2 Delivery times
Any delivery dates or times provided are estimates only and are not guaranteed. Delays may occur due to:

  • Customs inspection
  • Carrier issues
  • Local holidays or unforeseen events

5.3 Risk of loss
Risk of loss and title to the products pass to you when the products are delivered to the shipping address you provide.


6. Returns, Refunds & Cancellations

6.1 Return & refund policies
Return and refund eligibility may differ by Vendor and by product category. Please review:

6.2 How to request a return
If you wish to return a product or request a refund:

  1. Log in and go to My Orders;
  2. Open the relevant order;
  3. Contact the Vendor using the message/contact option.

You should clearly describe the issue (e.g., wrong item, damaged item, not as described) and provide supporting photos if requested.

6.3 Eligibility and conditions
Your return/refund may be approved, partially approved, or declined based on:

  • The applicable policy (time limit, condition of goods, type of product), and
  • Whether the issue is due to Vendor error, shipping damage, or your own change of mind.

6.4 Cancellation
Orders may be cancelled before shipment if permitted by the Vendor’s policy. Once shipped, cancellation may not be possible and a formal return process may be required.

6.5 Platform support
If you are unable to resolve an issue with a Vendor directly, you may contact our support team. We may review communication and available evidence and, at our discretion, assist with mediation. However, we are not obligated to provide a particular outcome.


7. Product Information & Intellectual Property

7.1 Product descriptions
Product descriptions, images, and specifications are provided by the Vendors. While we may review listings, we do not guarantee that all information is accurate, complete, or free from errors.

7.2 Patents and IP
Many products on this Marketplace are protected by patents or other intellectual property rights in Korea (and possibly other jurisdictions). You agree not to:

  • Copy, reproduce, or reverse‑engineer products for the purpose of infringement;
  • Use any intellectual property displayed on the Marketplace without the written consent of its owner.

7.3 Reporting issues
If you believe a product listing infringes your rights or is misleading, please contact us with details and we will review your report.


8. Prohibited Use & Misconduct

As a buyer, you agree not to:

  • Use the Marketplace for fraudulent or unlawful purposes;
  • Place speculative or fake orders;
  • Abuse return/refund processes;
  • Harass, threaten, or abuse Vendors, other users, or our staff;
  • Attempt to interfere with the security or operation of the Platform.

We may suspend or terminate your account and/or cancel orders if we suspect abuse or violation of these Terms.


9. Limitation of Liability

9.1 Marketplace limitation
To the fullest extent permitted by law, our liability to you in connection with your use of the Marketplace is limited. In particular, we are not liable for:

  • Any indirect, incidental, or consequential damages;
  • Loss of profit, revenue, or business;
  • Any issues arising from the acts or omissions of Vendors or third‑party service providers.

9.2 Cap on liability
Where our liability cannot be excluded, our total liability to you will not exceed the amount you paid to us in connection with the relevant order, to the extent permitted by applicable law.


10. Changes to These Buyer Terms

We may update these Buyer Terms from time to time. The “Last updated” date at the top of this page indicates the most recent changes.
By continuing to place orders after changes take effect, you agree to the revised Terms.


11. Governing Law & Dispute Resolution

The interpretation and enforcement of these Buyer Terms are governed by the laws of [Jurisdiction – e.g., Republic of Korea], without regard to its conflict of laws principles.

Any disputes arising out of or relating to these Terms, your use of the Marketplace, or any purchase made through the Marketplace shall be resolved as described in our Terms of Use.
